Luvu, Inc. ("Luvu," "we," "our," or "us") values your privacy. This Privacy Policy explains how we collect, use, disclose, and protect personal information when you use our website, mobile application, and other products or services that link to this Privacy Policy (collectively, the "Services").

By using the Services, you acknowledge the practices described in this Privacy Policy.

1. Information We Collect

We collect information directly from you, automatically through your device and use of the Services, and from third parties.

Information You Provide

Account Information
We may collect information such as your name, email address, password, profile image, and login credentials or identifiers associated with services like Apple or Google.

Profile, Fitness, and User Content
We collect information you choose to provide in connection with your use of the Services, such as workout preferences, workout history, sets, reps, completion status, fitness stats, notes, feedback, support requests, messages, and other submitted content.

Payment Information
We do not store full payment card details. Payments and subscriptions made through our iOS app are processed by Apple.

Information We Collect Automatically

Device and Technical Information
We may collect technical information such as your IP address, device identifiers, operating system, app version, language, time zone, device model, crash logs, and diagnostic information.

Usage Information
We collect information about how you use the Services, including features used, screens viewed, interactions with workouts, session duration, and analytics events.

Advertising and Similar Identifiers
Where permitted by law, and with consent where required, we may collect advertising identifiers and similar device-level identifiers.

Information from Third Parties

We may receive information from third parties such as authentication providers, payment providers, app stores, analytics providers, advertising or attribution partners, and other vendors that support our Services.

2. How We Use Information

We use personal information to:

  • provide, operate, maintain, and improve the Services;
  • create and manage accounts;
  • authenticate users and secure the Services;
  • personalize workouts, recommendations, and related experiences;
  • process purchases and subscriptions;
  • communicate with you about your account, workouts, support, updates, and service notices;
  • analyze usage, performance, bugs, and product quality;
  • develop, test, and improve features, including workout tracking and related machine learning systems;
  • enforce our terms, prevent misuse, and protect the security and integrity of the Services; and
  • comply with legal obligations and protect our rights.

We may also use aggregated, de-identified, or otherwise processed information for analytics, research, and product development to the extent permitted by law.

3. Workout Tracking Features

Some features of the Services analyze movement during workouts using your device's camera. We never access or process camera data for workout tracking without your consent.

In connection with these features, we may process pose or keypoint data, rep counts, exercise classification signals, and related technical metadata in order to provide workout tracking and improve feature performance.

If you are asked to share workout data for product improvement, participation is entirely optional. You can choose not to participate and still use the core Services, and you may change this setting at any time in the app.

We do not use workout tracking features for identity recognition or authentication. Your data remains protected from unauthorized access or use by third parties.

4. AI and Automated Features

Some features may use artificial intelligence, machine learning, or automated processing. If you interact with those features, we may log inputs and outputs to operate, improve, test, secure, and monitor those features.

AI-generated outputs may be inaccurate or incomplete and are not medical, legal, or professional advice. You should use your judgment and avoid submitting highly sensitive information unless necessary for the feature.

5. How We Share Information

We do not sell or rent your personal information for money. We may share information in the following circumstances:

Service Providers

We share information with vendors and service providers that help us operate the Services, such as providers for hosting, analytics, crash reporting, communications, customer support, authentication, subscription management, and infrastructure.

Product Improvement and Operations

Where relevant to the Services, and subject to appropriate confidentiality and security restrictions, service providers acting on our behalf may assist with product testing, quality assurance, support, analytics, or labeling and review workflows.

Advertising and Attribution Partners

Where permitted by law, and with consent where required, we may share device identifiers and related event data with analytics, attribution, or advertising partners.

Legal and Safety Reasons

We may disclose information if we believe it is reasonably necessary to comply with law, respond to lawful requests, enforce our agreements, investigate fraud or abuse, or protect the rights, property, or safety of Luvu, our users, or others.

Business Transfers

We may share or transfer information in connection with a merger, acquisition, financing, reorganization, sale of assets, bankruptcy, or similar corporate transaction.

With Your Direction or Consent

We may share information when you ask us to or otherwise consent.

6. Your Rights and Choices

Depending on where you live, you may have certain rights and choices regarding your personal information.

You may be able to:

  • access, update, or correct certain account information through the Services;
  • delete your account through the app or by contacting us;
  • manage device permissions such as camera, microphone, notifications, or tracking through your device settings;
  • opt out of certain non-essential communications;
  • withdraw consent where we rely on consent for specific processing; and
  • exercise rights available under applicable law, such as rights of access, deletion, correction, portability, objection, restriction, or appeal.

If you have opted in to a product improvement setting, such as sharing selected workout samples to improve feature performance, you can turn that off in the app Settings if available.

7. Data Retention

We retain personal information for as long as reasonably necessary for the purposes described in this Privacy Policy, including to provide the Services, maintain business and tax records, comply with legal obligations, resolve disputes, enforce our agreements, and protect the security and integrity of the Services.

Retention periods vary depending on the type of information and the purpose for which it was collected. When information is no longer needed, we may delete it, de-identify it, or aggregate it.

If you delete your account, we will delete or de-identify your personal information within a reasonable period, subject to any legal, security, fraud prevention, or operational retention needs.

8. Data Security

We use reasonable administrative, technical, and physical safeguards designed to protect personal information, including measures such as encryption in transit, access controls, monitoring, and vendor management.

No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

9. Children's Privacy

The Services are not intended for children under 13, and we do not knowingly collect personal information from children under 13. If we learn that we have collected such information without appropriate authorization, we will take steps to delete it.

We may update this Privacy Policy from time to time. If we make material changes, we will provide notice as required by law, such as by updating the effective date, posting notice in the Services, or otherwise notifying you.

Your continued use of the Services after the updated Privacy Policy becomes effective means you acknowledge the updated Policy, to the extent permitted by law.
