Terms of Service

1. Eligibility and Accounts

You must be at least 13 years old to use the Services. If you are under 18, you may only use the Services with the consent of a parent or legal guardian. Users under 18 cannot enable or access any profanity-related features and their profile images are visible only to approved in-app friends.

By creating an account, you agree to provide accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and all activity under your account.

2. Core Functionality

Luvu is a fitness accountability platform designed to support at-home fitness tracking, workout guidance, motivation, and social encouragement. Luvu provides:

• Personalized workouts
• Workout verification and completion tracking
• Performance and fitness statistics
• Motivational prompts and encouragement
• Social features, including friend connections and public progress sharing

3. Health, Medical, and Physical Activity Disclaimer

Before using Luvu, you should consult with a physician or qualified health professional, particularly if you have (or suspect you may have) any injury, illness, condition, or physical limitation that may be affected by exercise. This includes but is not limited to:

• Cardiovascular, respiratory, or neurological conditions
• Pregnancy
• Orthopedic injuries
• Diabetes or other metabolic disorders
• Obesity or extreme underweight conditions

By using Luvu, you affirm that you are voluntarily participating in physical activities, and you knowingly and fully accept all inherent risks associated with physical exercise—including the risks of injury, disability, or death.

Luvu does not verify or validate the safety or appropriateness of any specific workout, routine, cadence, challenge, or fitness suggestion presented by the Services or generated by our AI systems. You are responsible for:

• Listening to your own body
• Stopping any exercise if you feel faint, dizzy, in pain, or otherwise unwell
• Adapting or rejecting any activity that seems unsafe, uncomfortable, or inappropriate

We strongly recommend starting slowly and progressively ramping up activity. Using Luvu without proper preparation or against medical advice may result in serious harm.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LUVU DISCLAIMS ALL LIABILITY FOR INJURIES, MEDICAL CONDITIONS, ILLNESSES, DAMAGES, OR DEATH THAT MAY RESULT FROM USING OUR SERVICES.

4. User Conduct and Acceptable Use

You agree to use Luvu responsibly and respectfully. You may not:

• Post content that is harmful, harassing, violent, pornographic, hateful, or discriminatory
• Bully or harass other users, or use the Services to incite hatred or abuse
• Use the Services to impersonate others, mislead users, or spread misinformation
• Attempt to circumvent any privacy, safety, or age protections
• Interfere with or disrupt the operation of the Services, including through unauthorized scraping, crawling, or reverse engineering

We reserve the right to suspend or terminate accounts that violate these terms without prior notice.

5. User Content

Users may post content (e.g., profile photos, workout stats, or public messages). By uploading content, you:

• Grant Luvu a worldwide, royalty-free, perpetual license to use, display, and distribute that content in connection with the Services
• Waive any moral rights to the content, to the extent allowed by law

You are responsible for ensuring that all content you post complies with applicable laws and these Terms.

6. AI Interactions

Some features of Luvu involve interactions with AI-generated content. These include personalized workout routines, motivational prompts, and optional AI-based companionship features.

You understand and acknowledge that AI-generated responses may be inaccurate, inconsistent, inappropriate, or misleading. You agree to use your own judgment and discretion when acting on any AI-generated recommendation.

Luvu is not liable for any harm or consequences arising from interactions with AI content. We do not guarantee that responses will be accurate, neutral, or medically or scientifically valid.

Do not rely on any AI response for:

• Emergency medical situations
• Therapeutic or clinical advice
• Life-or-death decision-making

All interactions with the AI are logged to help improve safety and compliance.

7. Payments and Subscriptions

All payments are processed through Apple's In-App Purchase system. We may offer one-time purchases or recurring subscriptions. By subscribing, you authorize Apple to charge your selected payment method on a recurring basis.

You are responsible for managing your subscription through your Apple account. Refunds are subject to Apple's refund policy.

8. Notifications and Communications

Luvu may send push notifications if you enable them. These may include workout reminders, motivational prompts, or alerts about your progress. We do not send marketing emails or SMS messages outside of app use.

9. Termination

You may delete your account at any time within the app. You may also contact support@luvufit.com to request account deletion or data export.

We may suspend or terminate your access to the Services at our discretion, including for violations of these Terms, unlawful activity, or abuse of the platform.

10. Disclaimers and Limitation of Liability

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, LUVU DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING:

• IMPLIED WARRANTIES OF FITNESS FOR A PARTICULAR PURPOSE
• MERCHANTABILITY
• NON-INFRINGEMENT
• RELIABILITY OF ANY AI-BASED OR USER-GENERATED OUTPUT

IN NO EVENT SHALL LUVU OR ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES WHATSOEVER ARISING OUT OF OR RELATING TO:

• YOUR USE OR MISUSE OF THE SERVICES
• ANY MEDICAL OR PHYSICAL CONSEQUENCES OF USING THE SERVICES
• UNAUTHORIZED ACCESS TO YOUR ACCOUNT OR DATA
• ANY INTERACTION WITH OTHER USERS, WHETHER ONLINE OR OFFLINE
• ANY CONTENT POSTED BY USERS OR AI

11. Indemnification

You agree to indemnify and hold harmless Luvu, its officers, directors, employees, and affiliates from and against any and all claims, liabilities, damages, losses, or expenses—including legal fees—arising out of or in any way connected with:

• Your access to or use of the Services
• Any injury, health complication, or condition arising from physical activity
• Your violation of these Terms
• Your interactions with other users or AI
• Any content you post or share

12. Governing Law and Arbitration

These Terms are governed by the laws of the State of Pennsylvania, excluding its conflict of law rules.

All disputes shall be resolved by binding, individual arbitration in Pittsburgh, Pennsylvania under the rules of JAMS. You waive any right to participate in a class action or jury trial. You may opt out of arbitration by notifying us in writing within 30 days of your first use of the Services.

13. Miscellaneous

• These Terms constitute the entire agreement between you and Luvu.
• If any provision is found unenforceable, the remainder will remain in effect.
• No waiver by Luvu will be deemed a further or continuing waiver.
• You may not transfer these Terms without our consent.
• We may update these Terms at any time and will notify you of material changes.
